The Supreme Court (SC) En Banc has approved a new set of guidelines to streamline and standardize the computation of child support, establishing a uniform, evidence-based approach aimed at protecting the best interests of the child.
Approved on November 4, 2026, the Guidelines on Fixing of Child Support (Guidelines) complement the Family Code of the Philippines, as well as relevant court rules including the Rules on Action for Support and Petition for Recognition and Enforcement of Foreign Decisions or Judgments on Support (A.M. No. 21-03-02-SC) and the Rule on Provisional Orders (A.M. No. 02-11-12-SC).
Proposed by the SC Committee on Family Courts and Juvenile Concerns (CFCJC)—co-chaired by SC Associate Justices Amy C. Lazaro-Javier and Jhosep Y. Lopez—the new framework was crafted to resolve inconsistencies and variances in how courts previously calculated support payments across different jurisdictions.
While judicial discretion is preserved, the guidelines provide bench members with a standardized, objective formula anchored in the lived experiences and evolving needs of Filipino families.
Key Highlights of the New Guidelines
Standardized Formula: Aligned with the SC’s Strategic Plan for Judicial Innovations 2022–2027 (SPJI), the guidelines establish a uniform computation method to ensure efficiency, innovation, and broader access to justice.
Application Scope: The framework applies whenever there is no valid written agreement between parties, or when changing circumstances warrant an adjustment to existing child support amounts.
Expanded Scope of Obligors and Recipients: In line with the Family Code, the rules clarify which individuals beyond the biological parents are obligated to provide support. Recognizing shared caregiving structures in Filipino households, the guidelines also specify who may receive support on the child’s behalf, including scenarios with multiple designated recipients.
Quantified Value for Caregiving: In a major shift, the calculation accounts not only for basic needs and financial capacity, but also assigns a monetary value to the time spent caring for and supervising the child. Financial obligations are then proportioned relative to the actual level of care each party provides. -Paraluman News
