Senator Loren Legarda and her son, Batangas Rep. Leandro Leviste, have submitted their counter-affidavit in the plunder complaint being investigated by the Office of the Ombudsman.

Ombudsman Jesus Crispin “Boying” Remulla said on Friday the counter-affidavit was filed late but would still be considered by investigators as they proceed with the preliminary investigation.

“Nag-file na sila ng counter-affidavit. Late finile 'yung counter-affidavit, if I am right, but we’re not going to get them on any technicality; we will still consider the counter-affidavit,” Remulla said.

Legarda and Leviste were ordered by the Ombudsman to respond to allegations involving allegedly incomplete solar energy projects worth P10.44 billion. The plunder complaint against the mother and son was announced in late July.

Remulla said investigators were informed that the two lawmakers remained in Paris, although they had also traveled to Switzerland.

The Ombudsman said the preliminary investigation is expected to take up to 60 days, after which a resolution on the complaint may be issued.

Legarda and Leviste have both denied any wrongdoing in connection with the allegations.

Legarda is currently on extended medical leave from the Senate due to a lung-related illness.
