PH senate tribunal dismisses quo warranto case vs. Senator Erwin Tulfo

The Senate Electoral Tribunal (SET) has dismissed the quo warranto petition seeking to unseat Senator Erwin Tulfo over citizenship allegations.


In its resolution, the tribunal cited Rule 23(a) of the 2020 SET Rules, dismissing the petition for being "insufficient in form."


The resolution was signed by SET Chairperson and Supreme Court Senior Associate Justice Marvic Leonen, along with Senators Pia Cayetano, Robin Padilla, Kiko Pangilinan, and Bam Aquino.


The petition, filed on July 15, 2025, by Berteni Cataluña Causing, sought Tulfo’s removal based on claims regarding American citizenship, disloyalty to the Republic, violations of the political dynasty ban, and lack of academic qualifications.


Causing had earlier filed a disqualification case against Tulfo during the 2025 midterm elections, citing multiple grounds including a 2008 libel conviction.


He also accused Tulfo of violating provisions on equal access to public service and the prohibition against political dynasties, while raising questions about his citizenship and educational background.

The Commission on Elections (Comelec) had previously dismissed two disqualification cases against Tulfo based on procedural grounds.


Tulfo welcomed the ruling, stating that the legal challenges never hindered his service and that he remains focused on his duties in the Senate.


“Bagama’t may nakahaing quo warranto case noong bagong pasok pa lamang tayo sa Senado, kailanma’y di naman ito naging hadlang sa tapat nating pagseserbisyo. Tuloy lang po sa trabaho,” he said.
